5. Indemnification

You agree to indemnify, defend, and hold harmless CelestForge Publishing, its officers, employees, affiliates, and agents from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of this Agreement or misuse of the Site or its services.

6. Disclaimer of Warranties

All content and services provided through this Site are offered “as is” and “as available.”
CelestForge Publishing disclaims all express or implied warranties, including but not limited to warranties of title, non-infringement, merchantability, and fitness for a particular purpose.
We do not guarantee that services will be uninterrupted, error-free, or fully secure, or that the information provided is complete or current.

7. Limitation of Liability

CelestForge Publishing and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of or inability to use the Site, including data loss, revenue loss, or reputational harm.

12. Author Content and Submissions

When you upload or submit manuscripts, images, or documents through CelestForge Publishing’s submission forms or dashboards, you retain full copyright ownership.
However, by submitting content, you grant CelestForge Publishing a limited, non-exclusive, royalty-free license to process, display, and distribute your content solely for the purpose of publishing and related services under your agreement.

You represent and warrant that:

  • You own or have permission to use and publish the content;

  • The content does not infringe upon third-party rights;

  • It does not contain defamatory, obscene, or unlawful material;

  • It does not include malicious software or violate any law.

CelestForge Publishing reserves the right to reject or remove any submission that violates these conditions.

13. Responsibility for Published Content

Authors are solely responsible for their published content.
CelestForge Publishing does not verify or endorse author materials and disclaims liability for copyright infringement, defamation, or any legal disputes arising from such content.
Authors agree to indemnify CelestForge Publishing against any claims related to their published works.

14. Copyright Infringement and Reporting

CelestForge Publishing respects intellectual property rights. If you believe that any material hosted or linked on this Site infringes your copyright, please notify us with details of the alleged infringement.
We will investigate and, where appropriate, remove or disable access to the infringing material in accordance with applicable law.

15. Service Cancellation Policy

Cancellations are permitted only if the requested service has not yet commenced.
Once editorial, design, or production work has begun, all associated fees are non-refundable.
Any applicable payment gateway or processing fees will be deducted from refunds issued prior to service commencement.

16. Shipping and Delivery Policy

For physical copies or printed materials:

  • Domestic deliveries are handled through partner couriers or India Post.

  • International shipments may not include tracking and are subject to postal timelines.

  • Delivery times are estimates and not guaranteed.
    Print-on-demand titles require approximately 4–7 business days for production before dispatch.

17. Cancellation and Refunds Policy

All publishing services and print orders are processed on demand.
Once a book or project enters production or publishing stages, it cannot be canceled or refunded.
Replacements will be provided only for verifiable manufacturing defects (e.g., misprints or missing pages) upon proof submission at:

18. Service Delays

CelestForge Publishing is not liable for delays or interruptions caused by factors beyond its control, including natural disasters, technical failures, strikes, or force majeure events.

19. Jurisdiction

This Agreement shall be governed by and construed under the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India.
CelestForge Publishing’s international addresses (U.S. and U.K.) serve as virtual correspondence points only and are not registered offices or branches.

20. Termination of Account or Access

CelestForge Publishing reserves the right to suspend, limit, or terminate any user account or Site access without prior notice if a user is found violating these terms, engaging in fraudulent activity, or misusing the platform.
Upon termination, all licenses and access rights granted to the user will cease immediately.

21. Data Storage and Security

CelestForge Publishing implements reasonable administrative and technical measures to protect submitted data, manuscripts, and documents.
However, no online platform can guarantee absolute security.
The Company shall not be liable for any unauthorized access, corruption, or loss of user data due to circumstances beyond its control.
Users are encouraged to maintain personal backups of all submitted materials.

22. Payments, Royalties, and Taxes

All royalty payments and service fees are subject to Indian tax laws and CelestForge Publishing’s internal royalty policies.
Applicable taxes (such as TDS) may be withheld as per statutory requirements.
CelestForge Publishing acts only as a facilitator of royalty calculation and disbursement based on verified sales reports from distribution partners.
Authors must ensure accuracy of their payment and tax details to receive timely payouts.

23. Severability

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity and enforceability of the remaining provisions.
The remaining terms shall remain in full force and effect as if the invalid clause were removed.

24. Dispute Resolution and Arbitration

Any dispute arising from this Agreement shall first be resolved amicably.
If unresolved within 30 days, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, in Nagpur, Maharashtra, in English.
The arbitrator’s decision shall be final and binding. Each party bears its own costs unless otherwise directed.
